General conditions of sale

1. Object and scope

These conditions regulate the sale of horse trailers, vans and accessories between Remolque Caballos, S.L. and the consumer buyer.

By checking the corresponding box before confirming the order, the buyer declares that he has read and accepted them. It is the conditions in force on the date of the order that apply to that order.

2. Products

The product sheets describe the essential characteristics of each model: number of seats, maximum authorized mass, payload, box material, type of suspension and brake.

Illustrations are profile views drawn to scale, intended to allow comparison between models. They are not photographs of the specific vehicle that will be delivered and do not replace the manufacturer's technical sheet, which is delivered with the vehicle.

3. Prices

Prices are indicated in euros and include VAT at the general rate of 21% (article 90 of Law 37/1992).

The advertised price includes the vehicle, the registration process, the registration tax when applicable and the first technical inspection. It does not include delivery costs, which are calculated and displayed before order confirmation.

We reserve the right to modify prices at any time; The applicable price is the one that appears at the time of order confirmation.

4. Formation of the contract

The order is placed in three steps: contact information and addresses, choosing the payment method, and final review. In the last step, before confirming, the details of the items, the total amount and the applicable conditions are displayed.

The contract is completed when we send you the order confirmation by email. This confirmation constitutes the lasting support required by article 98.7 of the TRLGDCU.

5. Payment

The following forms of payment are accepted: bank card with 3-D Secure verification, Bizum, bank transfer, PayPal and financing for 12, 24 or 36 months subject to the approval of the financial institution.

For amounts greater than €3,000 we recommend the transfer: many Spanish entities limit the amount of card operations.

In case of transfer, the vehicle is reserved in your name and preparation begins upon receipt of the amount. No payment method carries a surcharge.

6. Delivery

We deliver throughout the Peninsula by specialized transport, on a date and time slot agreed upon by telephone. The Balearic and Canary Islands are budgeted separately, before the order.

The standard delivery time is 5 to 10 business days from when the vehicle is registered, which in turn requires 10 to 15 days. Priority delivery, within 48 to 72 hours from registration, is invoiced at €180.

In accordance with article 66 bis of the TRLGDCU, if we do not deliver within the agreed period and, following a request from you with a reasonable additional period, we continue not to do so, you can terminate the contract and obtain a full refund.

7. Transfer of risk and verification

The risk of loss or deterioration is transferred to the buyer at the time of physical delivery of the vehicle (article 66 ter of the TRLGDCU).

At delivery we check with you the coupling with your vehicle, the height of the headstock and the operation of the inertia brake. Please inspect the vehicle at this time and note any transport damage on the delivery note before signing it.

8. Right of withdrawal

You have fourteen calendar days to withdraw from the contract without the need for justification. The conditions, deadlines and form appear on the "Right of withdrawal" page, which is part of these conditions.

9. Legal guarantee

All vehicles and accessories are covered by the legal guarantee of conformity provided for in articles 114 et seq. of the TRLGDCU: three years from delivery for the goods, in its wording given by Law 4/2022.

During the first two years, it is presumed that the lack of conformity already existed at the time of delivery, without you having to prove it. The action to claim prescribes five years from the moment the lack of conformity is manifested.

We do not apply exclusions to the chassis, axle or brake system under the concept of "normal wear". Used units are sold with a two-year warranty in identical conditions.

10. Reservation of domain

The goods delivered remain the property of the company until the full price is collected. This reservation does not affect the transfer of risk, which occurs upon delivery.

11. Applicable law and jurisdiction

These conditions are governed by Spanish Law. The mandatory consumer protection provisions of the buyer's country of habitual residence remain applicable when they are most favorable to him.

In the event of a dispute, and unless otherwise mandatory, the courts of the consumer's domicile will have jurisdiction.
